It’s our policy to adhere to Canadian privacy standards. We are committed to upholding the highest standards of privacy and to use your information judiciously in an effort to provide you with the best possible service and convenience. This privacy policy (the “Policy”) explains how we gather and use your information and applies to any user using the Site and/or Services (as hereinafter defined) who uses our website located at https://sevita.com, applications, widgets, ads, and commerce services, or any service Sevita International Corporation (“Sevita”) makes available to you, (the “Services”) or any individuals, business partner-specific, merchant-specific, city-specific, or other area-specific websites we offer that link to or reference this Policy (collectively, the “Site”) and when you receive electronic communications from us.

Please read this Policy carefully and review it periodically for the latest information about our privacy practices. By using the Site and/or Services, you agree to the terms of this Policy and consent to the use of your information by Sevita as set forth herein. If you do not agree with the practices described in this Policy, please do not provide us with your personal information or interact with the Site and/or Services.

Sevita will routinely update this Policy to clarify our practices and to reflect new or different privacy practices, such as when we add new services, functionality or features to the Site. If we make any material changes, we will notify you [by e-mail (sent to the e-mail address provided by you to us) or] by means of notice on the Site prior to the change becoming effective. You can determine when this Policy was last revised by referring to the date it was “Last Updated” above. If you do not agree to the revised Policy, please stop using the Site and/or Services.

Collection of Information

This Site automatically logs information about a visitor from the browser used to access the Site (e.g., Internet Explorer, Chrome, etc.). This includes the I.P. address of the visitor and the pages in the Site, which are visited. Sevita collects only personal information that is relevant and necessary to the purpose of the Site and/or Services for the purposes of providing you with a customized and efficient experience. This information will be used by Sevita to diagnose problems with its web servers, to administer, design and construct its websites, to track visitor movements on the websites and gather broad demographic information for aggregate use only.

Please note that this Policy only covers information collected by and through the Site and/or Services. It does not apply to any third-party websites linked to the Site. We cannot assume any responsibility for the privacy practices, policies or actions of the third parties that operate these websites or services. By using the Site and/or Services you acknowledge that the Site and/or Services may be provided through or in conjunction with third parties and that your use of such third-party services is governed by such third-party’s then applicable privacy policy and terms of use. Sevita is not responsible for how such third parties collect, use or disclose your personal information. We advise you to review the privacy policies of these websites and services before providing them with personal information.

The Sevita Site and/or Services collect personally identifiable and non-personally identifiable information including, but not limited to, the following:

  • Internet Protocol (IP) addresses of the computers being used to access our Site and/or Services;
  • Operating systems and the types and versions of browsers used to access our Site and/or Services;
  • Internet Service Providers used by visitors to our Site and/or Services;
  • Dates and times users access our Site and/or Services;
  • Pages visited;
  • Keywords users enter into our search engine; and
  • Names and sizes of files requested.

Please note that you can choose not to provide us with certain personal information, but then you may not be able to take advantage of all of the Services or access all parts of the Site

From time to time, we may also ask you to provide us with non-personally identifiable information, that is, data that is not intended to allow us to identify you personally, such as your [first name, birthday or postal code]. This information may be aggregated and used for our internal purposes or for creating reports for third-party advertisers and partners, or otherwise shared with third parties for any lawful purpose, without your permission. No third-party is intended to be able to know who you are as a result of the use of this information.

We also may automatically collect Site and Service usage information, such as the numbers and frequency of users to the Site and/or Services, pages visited and similar data. This data is used in the aggregate, that is, as a statistical measure, and not in a manner that is intended to identify you personally. Aggregate information generally is collected through the use of cookies as discussed below. This aggregate information helps Sevita determine general usage patterns and modify the Site and/or Services in order to improve your experience. This type of aggregate information may be shared with third parties at any time.In addition to our use of non-personally identifiable information as described herein, we may permit certain third-party companies to help us tailor advertising that we think may be of interest to you based on your use of the Site and/or Services and to otherwise collect and use non-personally identifiable data about your use of the Site and/or Services.

Personal Information may be collected in different ways:

Areas of the Site may request users to provide a "user ID" and password. Visitors to the Site may be asked to supply their name, geographic location and some information about their business or occupation or other reason for interest in the Site. In addition, some areas request users to supply an e-mail address to sign up for newsletters and news feeds. Feedback or comment forms whereby users can submit questions or comments are also on this Site.

From time to time our Site may request additional information from users through surveys or contests. Participation in these surveys or contests is voluntary and the user has the choice to disclose whatever additional information may be requested. Information requested through surveys and contests may include additional demographic information.

Passive Gathering of Information Electronically and Cookies

We receive and store certain types of information whenever you interact with the Site and/or Services. Sevita automatically receives and records certain “traffic data” on our server logs from your browser, including your IP address, cookie information, and the page you requested. Sevita uses this traffic data to help diagnose problems with its servers, analyze trends and administer the Site and the Services.

When you access or use the Site and/or Services, Sevita may use industry-wide technologies such as “cookies” (or similar technologies), which store certain information on your computer (“Local Storage”) and which will allow us to enable automatic activation of certain features, and make your Site and/or Service experience much more convenient and effortless. The cookies used by the Site and/or Service are created per session and do not include any information about you, other than your session key and are removed as your session ends (usually after 24 hours). It is easy to prohibit the Local Storage. Most browsers will allow you to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. However, if you block or erase cookies your online experience may be limited.

Personal information of individuals with whom we interact.

We receive and store any information you enter on our Site and/or Services, or that you provide to us in any other way, including by e-mail. When you send an e-mail to Sevita, we may retain your e-mail address and the contents of the e-mail you send. Please note that your use of your specific e-mail provider is governed by such provider’s then applicable terms of use and privacy policy.

We collect and maintain different types of personal information, which could include, but are not limited to, the following:

  • Contact and identification information, such as your name, address, telephone number and e-mail address;
  • Product and service related information concerning the products and services that we provide to, or receive from, you;
  • Information about farmers’ farming practices;
  • Credit and financial information such as your payment preferences; and
  • Business relationship information, including information related to your agreements, preferences, advisors and decision-makers, feed-back and information requested by or provided to you.

If you are entitled to payment by Sevita or to make payment to Sevita, Sevita may require and may receive certain financial information in order to make payment to you or to receive payment from you, including, but not limited to [relevant third-party payment processor account information, direct deposit banking information,] or other information required to facilitate payment to you or Sevita (the “Financial Information”). Rest assured that Sevita will not share your Financial Information with any third-party except as required in order to facilitate such payments in accordance with your agreement with Sevita. [In the event that you use a third-party payment processor in order to receive or send a payment from Sevita, including but not limited to PayPal, your use of such third-party payment processor shall be governed by their then applicable terms and conditions and/or privacy policies.]

When you request information from us, we may use the e-mail address that you provide to send you information about offers on products and services that we believe may be of interest to you.  If you have asked us to put you on an e-mail mailing list to provide you with certain information on a regular basis, or if we send you information about our offers on products and services by e-mail we will use the email address that you provided to us.

Sevita permits you to simply opt out of receiving promotional materials. If you would like to “opt out”, you may do so by way of the “Opt Out” link or “unsubscribe” link contained in the e-mail messages delivering such materials. As well, you may ask us to remove you from a list at any time by emailing us at info@sevita.com and identifying yourself and describing the personal information, which you believe has been collected through this site.

We may also collect market-related information, which may include personal information concerning market trends and activities impacting our business.  This information may include contract terms, financial information and other information for the purpose of market analysis and strategic planning. 

We may also collect information related to our media, investor and public relations activities and information related to our interactions with financial and other analysts and advisors.

We assume that, unless you advise us otherwise, you have consented to the collection, use and disclosure of your personal information as explained in this Policy.

Retention of Personal Information

Sevita will periodically delete personal information collected from visitors to its Site if it is no longer needed for any purpose for which the information may be used or disclosed under the terms of this Policy.

Security

Sevita takes precautions to protect users' information. Our safeguards include industry accepted tools and techniques and policies and procedures that our staff is trained to follow to protect against unauthorized access to systems. The Sevita Site is hosted by a third-party and therefore these safeguards shall also apply.

We try to reduce the likelihood of accidental disclosures and unintended access and modification of account information, but it is impossible to eliminate this possibility completely. When users submit sensitive information via the Site and/or Services, their information is protected both on-line and off-line.

When an enrollment or order form asks users to enter sensitive information, it is encrypted and protected with the Secure Socket Layer (“SSL”) technology. While Sevita uses SSL encryption to protect sensitive information online, it also takes steps to protect user-information off-line. All of our users' information, not just the sensitive information mentioned above, is restricted in our offices. Sevita employees are kept up-to-date on our security and privacy practices. Any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our customers' information is protected.

You should be aware, however, that Sevita has no control over the security of other websites on the Internet that you might visit, even where such other site is linked to our Site and/or Services. If you share your computer or use a computer that is accessed by the general public, remember to sign off and close your browser window when you have finished your session. This will help to ensure that others cannot access your information.

We want you to feel confident using the Site and/or Services. However, no system can be completely secure. Therefore, although we take commercially reasonable steps to secure your information, we do not promise, and you should not expect, that your information, searches or other communications always will remain secure. In the event of a breach of the confidentiality or security of your information, we will notify you if reasonably possible and as reasonably necessary so that you can take appropriate protective steps. We may notify you under such circumstances using the e-mail address(es) we have on record for you. We assume no responsibility or liability whatsoever with respect to losses or theft or other exploitation of data received by Sevita by Site and/or Service users in the event of a breach of confidentiality or security. Please keep in mind that whenever you voluntarily disclose personal information online - information can be collected and used by others. Ultimately, you are solely responsible for maintaining the secrecy of your passwords and/or any account information. How Do We Use Your Information?

When you provide Sevita with your information, we may use such information for a number of purposes, including:

  • To facilitate communication between Sevita and you including, without limitation, responding to your questions or comments, sending e-mails concerning our products and services, or to contact you for feedback regarding us, our advertisers or our business partners;
  • To administer your account, process payments, provide products or services to you and for Sevita marketing and promotional activities;
  • [To provide a report to business partners that tells them who responded to a particular offer or to facilitate the fulfilment of an order that you have made with an advertiser or business partner;]

Your personal information may be used to communicate with you about your use of our Site, to let you know about changes to our Site and/or Services, or to provide services to you or to improve our understanding of what visitors want and need to see on the Site. In particular, user information may be used to improve the efficiency of the Site and/or Services and to ensure the information which is provided is timely and relevant and meets the needs of our visitors. Sevita may also use the information which visitors voluntarily submit through the Site and/or Services to provide information and promotional material to persons who have visited the Site and to process specific requests for information which visitors may make. Please refer to "Opting In / Opting Out" above if you do not wish to receive this material.

Survey Information will be used in a manner similar to User Information but will be used primarily in aggregate form to provide Sevita with information on customer needs, [product design, ]market demand, etc.

Disclosure of Information to Third Parties

Rest assured that Sevita neither rents nor sells your personal identifiable information to anyone and that we will share your personal identifiable information only as described below.

A. Fulfilment of Services

We may retain other companies and individuals to perform certain functions on our behalf. Examples include, but are not limited to, companies and individuals who: (i) administer the Sevita accounts; (ii) process payments; (iii) conduct surveys or promotional activities; (iv) deliver products or services; or (v) provide customer support, web hosting, internet service, and data analysis. Such third parties may be provided with access to information needed to perform their functions but may not use such information for any other purpose.

B. Protection of Sevita and Others

We may release personal identifiable information when we believe in good faith that release is necessary to comply with a law; to enforce or apply our terms of use and other policies; or to protect the rights, property, or safety of Sevita, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

C. Business Transfers

In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that are transferred. Moreover, if Sevita, or substantially all of its assets, were acquired, user information would be one of the assets transferred.

D. Sevita Personnel

Sevita personnel and authorized consultants and/or contractors may have access to personal identifiable information, where such access is necessary in the normal course of the Sevita business.

Users from Outside Canada

Sevita is located in Canada. This Policy is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The Site may be hosted in Canada or in the United States. If you are visiting the Site from outside Canada or the United States, please be aware that your information may be transferred to, stored and processed in Canada or the United States, where our servers are located and our central database is operated. The data protection and other laws of Canada and the United States might not be as comprehensive as those in your country. By using the Site and/or Services, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share that information as described in this Policy.

TRADEMARKS

Roundup Ready 2 Xtend®, XtendFlex®, and Roundup Ready® 2 Yield Soybeans
Bayer is a member of Excellence Through Stewardship® (ETS). Bayer products are commercialized in accordance with ETS Product Launch Stewardship Guidance, and in compliance with Bayer’s Policy for Commercialization of Biotechnology-Derived Plant Products in Commodity Crops. These products have been approved for import into key export markets with functioning regulatory systems. Any crop or material produced from these products can only be exported to, or used, processed or sold in countries where all necessary regulatory approvals have been granted. It is a violation of national and international law to move material containing biotech traits across boundaries into nations where import is not permitted. Growers should talk to their grain handler or product purchaser to confirm their buying position for these products. Excellence Through Stewardship® is a registered trademark of Excellence Through Stewardship.

ALWAYS READ AND FOLLOW PESTICIDE LABEL DIRECTIONS. It is a violation of violation of federal law to use any pesticide product other than in accordance with its labeling. NOT ALL formulations of dicamba, glyphosate or glufosinate are approved for in-crop use with products with Roundup Ready 2 Xtend®, XtendFlex®, or Roundup Ready 2 Yield® Technology. ONLY USE FORMULATIONS THAT ARE SPECIFICALLY LABELLED AND APPROVED FOR SUCH USES. Contact the Pest Management Regulatory Agency with any questions about the approval status of dicamba herbicide products for in-crop use with Roundup Ready 2 Xtend® soybeans or products with XtendFlex® Technology. 

Roundup Ready 2 Xtend® soybeans contain genes that confer tolerance to glyphosate and dicamba. Glyphosate will kill crops that are not tolerant to glyphosate. Dicamba will kill crops that are not tolerant to dicamba.

Products with XtendFlex® Technology contain genes that confer tolerance to glyphosate, glufosinate and dicamba. Glyphosate will kill crops that are not tolerant to glyphosate. Enlist E3® Soybeans

Enlist E3® soybeans contain the Enlist E3 trait that provides crop safety for use of labeled over-the-top applications of glyphosate, glufosinate and 2,4-D herbicides featuring Colex-D® technology when applied according to label directions. Following burndown, the only 2,4-D containing herbicide products that may be used with Enlist™ crops are products that feature Colex-D technology and are expressly labeled for use on Enlist crops. 2,4-D products that do not contain Colex-D technology are not authorized for use in conjunction with Enlist E3 soybeans. WARNING: Enlist E3 soybeans are tolerant of over-the top applications of glyphosate, glufosinate, and 2,4-D. Accidental application of incompatible herbicides to this variety could result in total crop loss. When using 2,4-D herbicides, grower agrees to only use 2,4-D products that contain Colex-D technology authorized for use in conjunction with Enlist E3 soybeans.
